Welcome to tamaramaksimovic.com (the “Site”), operated by Tamara Maksimović (“Artist,” “we,” or “us”). Please read these Terms & Conditions (“Terms”) carefully before using the Site or any related services, including online print sales, commission inquiries, or newsletter sign-ups (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

2. ELIGIBILITY

You must be at least 18 years old (or have parental consent) to use the Services. By using the Services, you represent and warrant that you meet this requirement.

3. USE OF THE SITE

  • You may view, download, and print content for your personal, non-commercial use only.

  • You may not reproduce, distribute, modify, display, or otherwise exploit any of the Site’s content for any public or commercial purpose without our prior written permission.

4. COMMISSION INQUIRIES & PURCHASES

  • All commissions are subject to availability. Contact us via the form or at art.tamara.maksimovic@gmail.com to discuss details.

  • A non-refundable deposit of 50 % is required to secure a commission slot; the balance is due upon completion.

  • All sales are final. No returns or refunds except in the rare event of damage in shipping (see Section 6).

5. PRINT SALES

  • Prints are reproductions of original works and are sold in limited editions.

  • Each print is signed and numbered by the Artist.

  • Shipping costs and any duties or taxes are calculated at checkout and are the buyer’s responsibility.

6. SHIPPING & DAMAGE CLAIMS

  • We package prints and small originals carefully, but if an artwork arrives damaged, you must notify us within 48 hours of delivery.

  • Please send clear photographs of the damage to art.tamara.maksimovic@gmail.com.

  • We will arrange either a replacement (if available) or a refund of the purchase price only (shipping non-refundable).

7. INTELLECTUAL PROPERTY

  • All text, images, artwork, and design on the Site are the Artist’s property and are protected by copyright and other intellectual property laws.

  • You may not use our trademarks, logos, or content without express written permission.

8. USER-GENERATED CONTENT

  • Comments, questions, or feedback you submit via contact forms become our property. We may use them for any purpose without compensation to you, though we will always credit the Artist when showcasing your testimonial.

9. PROHIBITED CONDUCT

When using our Services, you agree not to:

  • Harass, threaten, or defame any person.

  • Upload viruses or malicious code.

  • Crawl, scrape, or otherwise harvest data from the Site without our consent.

  • Impersonate any person or entity.

10. PRIVACY

Your use of the Site is also governed by our Privacy Policy. By using the Services, you consent to our collection and use of your personal data as described there.

11. DISCLAIMER OF WARRANTIES

The Site and Services are provided “as is” without warranty of any kind. To the fullest extent permitted by law, the Artist disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. LIMITATION OF LIABILITY

Except where prohibited by law, in no event will the Artist be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your use of the Services.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Tamara Makasimović from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from your breach of these Terms or your misuse of the Services.

14. CHANGES TO THESE TERMS

We may update these Terms at any time by posting a new version on the Site with a revised “Last updated” date. Your continued use of the Services after changes constitute your acceptance of the new Terms.

15. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of Serbia. Any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Belgrade, Serbia.
